Employees are most likely to file lawsuits against an institution based on discrimination, harassment, wrongful terminations, and workplace injury. Accusation on discrimination accounts for thousands of lawsuits filed whether based on disability, gender, orientation, or race (Walter, 2013). Discrimination against employees during the process of hiring and at workplaces violates various federal laws and cases are mostly handled by Equal Employment Opportunity (EEO) division which liaises with employees for easier suing (Walter, 2013). Disciplining or firing an employee by an institution requires proper documentation. Harassment suits may involve sexual advances for instance touching or inappropriate comments or workplace bullying and violence. Annually, the EEO division investigates 12,500 harassment suits (Walter, 2013). Harassment may originate from a co-worker, customer, client, supervisor, or a manager.
An institution should have a policy handbook including strict rules on harassment and rules concerning false claims. Wrongful termination results when a worker is laid off or fired unlawfully (Scott, 2013). Victims who file a wrongful termination suit are entitled to compensation which includes lost wages and probably punitive damages depending on the severity of a situation. An institution should have a documented process which details terminations. There is an increase in suits involving wrongful termination and fifty percent of the suits are won by former employees in the majority of the states. Employees may file law suits as a result of workplace injuries. In 2009 over 3.2 million workplace injuries were reported according to Bureau Labor of Statistics (Scott, 2013)...
