Issue or Problem
Hearsay refers to out-of-court information given to verify the truth of anything it claims that is then provided in evidence to attest to the truth. Hearsay addresses the admissibility of secondhand proof in court, which is a significant problem in the legal system. The challenge is that achieving credibility becomes hard whenever the mentioned individual is absent. Besides, the hearsay rule has several exceptions, including excited utterance, present sense impression, and recorded recollection. Therefore, the intricacy of these exceptions and the possibility of unfair results have driven calls for reforms.
Personal Interest
I have encountered firsthand challenges to evidence of hearsay presented in criminal cases, which led me to develop a deep interest in the policy. I am also interested in this policy because achieving a balance between fairly served justice and maintaining the integrity of judicial undertakings fosters the importance of reforming the hearsay policy.
Sources
Sevier (2023) attests that the hearsay rule tended to be straightforward and sensible, forbidding witnesses from recapping secondhand, unverified gossip in court. Alternatively, the essay states that the rule confuses law students, vexes trial judges, and confounds practicing attorneys. The paper is relevant to my policy as it asks why such a straightforward rule causes so much confusion, claiming various reasons.
