Woolley V. Hoffman LaRoche
1. What is the issue in this case? The issue here is a breach of contract Woolley alleges that the termination clause in the manual states that an employee will be fired only for cause. This factor prevented Hoffman from firing Woolley without cause.
2. How would you categorize this particular conflict? This is an interest dispute in that Woolley knows his employment can’t be terminated for exercising their legal rights not to be fired without a good cause.
3. What is the background that leads to this conflict? Plaintiff, Richard Woolley, was hired by the defendant, Hoffmann-La Roche, Inc., in October 1969, as an Engineering Section Head in Central Engineering Department at Nutley. There was no written employment contract between plaintiff and defendant. Plaintiff began work in mid-November 1969. Sometime in December, the plaintiff received and read the personnel manual on which his claims are based.
The plaintiff was promoted twice in 1976 and 1977 respectively; the plaintiff was asked for his resignation to be effective, July 15, 1978. The plaintiff refused to resign, two weeks later, he was asked again and told him he would be fired if he did not resign. Plaintiff again declined, and he was fired in July.
