The Supreme Court usually determines which cases to hear or not to hear based on the decisions of at least four of the nine Justices who accept to grant the Petition for Certiorari. Furthermore, the Supreme Court does not have any jurisdiction to hear most cases. In Billy Ray Irick v. Tennessee, Justice Kagan was presented with an application for a stay of execution of the death sentence, but this request was denied (supremecourt.gov, 2018).
