As a district attorney, I would charge summer Breeze with an aggravated battery because she inflicted a severe injury to a victim (Samuel Clark). Her action resulted in permanent brain damage to the victim. In particular, she hit Clark with her shoes in the side of Clark's head, rendering him unconscious. Georgia criminal code law states that a person commits aggravated battery when they maliciously cause bodily harm that renders the victim useless or becomes seriously disfigured (Findlaw, 2018). Clark suffered brain damage, rendering him useless due to harm inflicted by Breeze. Therefore, Breeze deserves between one and twenty years in prison.
Skeeter Redrum would be charged with two accounts: - simple assault and simple battery. On the first account, Redrum and Bubba Hurt threatened the victim. They were heard yelling at Clark to leave Summer Breeze alone and telling him that it was the last time he puts his hands on her. According to Georgia Criminal code, this verbal threat is a simple assault that warrants up to one year jail, a fine of $1,000, or both (Findlaw, 2018).
On the second account, Redrum kicked Samuel Clark in the face intending to cause physical harm to the victim. Based on the Georgia code, simple battery is a misdemeanor, and the suspect must have physical contact with the victim to be charged. Again, the accused would serve a maximum jail term of one year, a fine of $ 1,000, or both (Findlaw, 2018).
It would be unreasonable to press charges on Bubba Hurt because he is dead and cannot answer his crimes. However, had he survived, charges would have been a simple assault, simple battery, and aggravated battery. His abse...
