Abstract
The paper explains the impact of economic, social, political, and cultural issues on the development of the United States Constitutional Law System (USCLS). Since the Constitution does not function in a vacuum, the above problems might have influenced its implementation directly or indirectly. For example, many delegates involved in developing the Constitution sided with specific political parties. That is why some of the demands they made were politically aligned. Those from the Southern States might have demanded the slave trade to be legalized since they were stakeholders of large plantations, and needed cheap labor. Their colleagues from the Northern States did not have an interest in slavery. The paper examines all these issues one after the other. Specifically, it starts by introducing the topic before examining the above-stated problems one-by-one in the following order: political, social, economic, and cultural issues. The most significant thing that delegates ensured is coming up with a universal Constitution that fosters the well-being of everyone regardless of individuals’ differences. For instance, the Constitution uses terms, such as citizens and immigrants, and does not promote racial discrimination. When it comes to freedom of speech and life, all individuals exercise these privileges. The three branches of the government, namely the executive, legislature, and judiciary were formed to govern the USCLS. That way, the Constitution ensures checks and balances. The federal government undertakes its functions without interfering with the power of independent states. As such, despite the effect of the economic, social, cultural, and political problems, the development of the USCLS was not adversely affected, and delegates ensured to come up with universal laws that govern all the states fairly and equally.
The United States Constitutional Law System (USCLS) plays significant roles since it established fundamental laws and guaranteed specific basic rights for all Americans. The Constitutional Convention took place in Philadelphia in 1787. The Constitution strengthened the federal government, which has three branches, namely judicial, legislative, and executive. In addition, it ensures checks and balances to prevent some branches to have more power than others. However, during the development of the USCLS, the process was affected by social, political, economic, and cultural problems. The paper focuses on the impact of economic, social, political, and cultural issues on the creation of USCLS.
Political issues impacted the development of the USCLS in various ways. Fifty-five delegates who met in Philadelphia in 1787, amended the Articles of Confederation, which was signed to become the first Constitution of the United States of America (USA). Political factors significantly contributed to the formation of the USCLS since states needed universal laws that would govern them to ensure that they did not act as independent countries, but rather were under the same law. For instance, during the formation of the USCLS, some of the pressing issues were slavery, Americans’ rights, and states’ representations (Novkov, 2018). In some instances, political issues, such as deciding the number of representatives in large and small states made the constitutional development process challenging. Although some rules from the Articles of Confederation were implemented in the USCLS without changes, others had to be amended to meet the political needs of all states and ensure uniformity. Notably, delegates were influenced by several political issues while developing the USCLS. For example, Northern States wanted to abolish slavery while Southern States threatened to opt out if their demands, such as keeping legal slave trade were not met. As such, the USCLS had to be formed in a way that did not favor specific states or individuals regardless of their political influence in the formation process.
Another political issue that impacted the development of the USCLS was how to bolster the power of the federal government to avoid loose sovereign states’ confederation. In particular, having a weak federal government would have left the states with more power. That is why the development of the USCLS was a crucial political process. Additionally, American constitutional law ensured that courts were declared as democratic institutions so that they can govern the rules without the interference of political agents (Novkov, 2018). When the USA was governed by the Articles of Confederation, the states retained much sovereignty and independence. However, it was politically challenging to determine and assign the federal government only the nationally crucial functions that individual states could not handle independently. Delegates were focused on limiting the government’s power and ensuring that citizens had liberty. In that light, the judicial, executive, checks and balances, and power separation were all done to address political issues that might have arisen even after the implementation of the USCLS.
Social issues influenced the development of the USCLS. The USA Constitution does not govern using the written text only. The Constitution is affected by other factors, including social, customs, and dialogue between political and social institutions (Fisher, 1987). Besides, it is not a rigid document that cannot change depending on the dynamics of society. The Constitution is supposed to embrace social changes within the scope of the conferred terms and powers. Even during the development of the USCLS, social issues, such as racial discrimination and slavery, existed. That is why the authors of the USCLS were careful to differentiate between political and social issues. On that note, they established the judicial and gave it powers to be an independent and non-political branch of the government (Fisher, 1987). Science cannot be used to measure the relationship between the judicial effect and social cause. But informed judgments can be made about social influences to specula...
