Respondeat Superior is a concept stating that employers, and in this case, hospital governing bodies, are responsible for their employees. Specifically, employers can be held liable for any tort an employer commits (Bastable, 2021). These torts include negligence and medical malpractice. The hospital incurs vicarious liability as long as the tort was committed by healthcare professionals during their routine duties. Bastable (2021) reveals that under Respondeat Superior, the hospital can be held liable for damages.
