HIPAA Privacy Rule
An act of legislation known as the Health Insurance Portability and Accountability Act (HIPAA) Privacy Regulation lays out guidelines for safeguarding the confidentiality of patient health information. The HIPAA Privacy Rule outlines requirements for how healthcare providers and other organizations dealing with protected health information must safeguard the privacy of patients' medical records (Moore & Frye, 2019). According to the Privacy Rule, these organizations must have the proper administrative, physical, and technical measures to maintain individual health information's privacy and security. Access control, authentication, and encryption technologies are some of these safeguards.
Following the Privacy Rule, organizations must give people reasonable access to and control their health information. This includes the right to get a copy of their medical records and the right to have any errors in those records corrected. Additionally, the Privacy Rule mandates that these organizations advise people of their privacy rights and their health information's potential uses and disclosures (Stiles & Appelbaum, 2019). The Privacy Rule also demands that organizations acquire consent from people before using or disclosing their health information for fundraising or marketing or before selling it. Finally, the Privacy Rule mandates that organizations notify the Department of Health and Human Services of any breaches involving protected health information.
The HIPAA Privacy Rule has had a significant impact on the healthcare industry. It has affected how healthcare providers interact with patients. Providers must guarantee that all patients' data stays confidential and that only certified persons can access it. Providers must also issue patients access to their records and the ability to delete or correct any inaccurate or outdated information. The Rule also requires that providers document all disclosures of patient information and that any disclosures made for purposes other than treatment, payment, or healthcare operations must be authorized by the patient (Moore & Frye, 2019). Additionally, the Rule requires providers to have procedures in place to respond to patient requests for access to their information and to ensure that any third parties granted access to patient information do so as per the HIPAA Privacy Rule. Finally, the Rule requires providers to notify patients in the event of unauthorized disclosure of their data.
