Exceptions when it comes to maintaining the confidentiality of HIV-related information
In the health care sector, doctor-patient confidentiality is paramount. However, certain exceptions exist where this law can be overruled. One such case is where the health status of that individual cause risks to a third party such as a spouse or family member. Thus, is becomes an obligation for the medical personnel to warn a person at risk because duty to warn overrides duty to confidentiality (Siegler & Winslade, 2002). Also in legal requirement, confidentiality may be exempted because such information needs to be shared to the government health sector. The information is important for the relevant bodies since it enables the government protect public health and avail the required medical interventions such as provision of ARVs for HIV patients.
