Maintaining worker's confidentiality and privacy is essential for creating trust and ensuring that all employees are safe in the workplace. A national standard for protecting the privacy of health information has been implemented by the federal Health Insurance Portability and Accountability Act (HIPAA). This law is applicable to health records maintained by health plans, health care providers, and health clearinghouses (Chait & Glied, 2018). Therefore, in the case of Sara, the employer should have protected her medical information and ensure that she receives the necessary treatment. Based on the employee assistance program (EAP), Sara's medical information is protected under HIPAA or any other privacy policy that is used to safeguard medical information. Health communication and advocacy should not be misused at the expense of exposing the confidential medical records of an employee.
However, employers may be required to disclose certain medical information about employees. For instance, the Americans with Disability Act (ADA) requires employers to disclose certain information about the medical history of employees. The ADA restrict managers from getting medical information from workers but allows them to conduct medical examination based on the employee health program. For instance, information that should be disclosed to managers and supervisors is the one that is needed to offer reasonable accommodation and meet restrictions of employers. Furthermore, first aid information should be disclosed if an employee requires emergency treatment like during emergency evacuation.
