An important legal consideration for K-12 leaders need to consider is the compliance with the Individuals with Disabilities Education Act (IDEA). Essentially, the IDEA is used to guarantee that disabled learners receive a free and appropriate public education (FAPE) in the least restrictive environment (Zirkel, 2019). The litigation in special education can generally be initiated in cases whereby the schools fail to live up to these guarantees. In this paper, the issues of how schools can avoid litigation under the IDEA brought about by the errors are discussed.
Prevention mindset dictates that school can avoid litigation by addressing common pitfall associated with IDEA. A common pitfall of IDEA that can lead to litigation is denying a learner FAPE on the basis of the inadequate instructional support, incorrect placement or absence of actual progress of the students (Zirkel, 2019).
