Criminal justice system tends to have opponent relations between defense and prosecution according to the views of some people. This could be due to the way the two components always seem to be in contrary of each other during the criminal case proceeding (Worrall, 2008). On the other hand, criminal court research has indicated that the relationship between the defense and prosecution is that of cooperation. The personal characterization of the two is that there is cooperation because of a number of reasons.
The defense and prosecution cannot be considered as adversaries since they both work towards the implementation of a mutual course. The fact is even though there is always the side of the state, which is represented, by the prosecutor and the individual liberty represented by the defendant, they have a cooperate relationship. The main dispute that is supposed to be resolved by the criminal courts is usually between the state and defendant, which determining if the defendant broke the law. In case the law was violated by the defendant, there is a decision made on the action to be taken. The design of the criminal court is that the defendant should be concerned about the liberty of an individual, while the state’s concern is the control of crime in the country or the world at large. This does not place the two in conflicting sides; it is just a systematic way of both ensuring that the law is in action (Neubauer, 2011).
