Where possible, business owners should opt for alternative dispute resolutions to avoid the protracted and involving court processes. The alternative dispute resolution options a business owner might consider in this case are mediation and arbitration.
Mediation
Mediation is an informal procedure in which the customer and the gym owner sit together with an impartial mediator who fosters dialogue on the issue and attempts to come up with a satisfactory solution for both parties. This person plays the key role of directing the discussion, recognizing the main fears and interests of the conflicting parties, and leading them to an agreement. Mediation is generally less confrontational, and predictable in cost and duration compared to litigation, and it offers the parties more control over the decision. The main advantages in this situation are that mediation will afford a platform for the customer to be able to communicate with the gym owner and possibly find workable solutions. The mediator can explain to both parties their rights and actively involve the parties in arriving at the final agreement.
