The plaintiff is Danny Kyllo
The defendant is the United States government
The plaintiff Danny Kyllo is suspected by two agents from a government force to grow marijuana using high intensity lamps in his private residence. He is found with the evidence of marijuana and arrested but in court argues and the evidence of using thermal image scans is discredited since there are no motion sensors. Eventually Danny is released and now sues the government for invasion of privacy as the use of thermal surveillance on his residence invaded his right to privacy.
Issue to be resolved
The court must resolve whether the use of thermal scanners on a private residence invaded the privacy of the plaintiff. This is despite the fact that he was found to be growing over 100 plants of marijuana. The plaintiff should not have continued with the suit as he had already been cleared with the charges of growing marijuana, it raises more questions than answers on his part to sue the government for using outdated technology to expose his illegalities.
