Did the school provide an Asian student detailed explanation for what the school provided as the basis for each alleged violation?.
The school did not provide me the detailed explanations as to the basics for each alleged violation. The picture of the snapshot is the only given for allegations of these violations.Please provide answers to the following questions for petition amendment:#1: Failure to comply with a directive from a college official, faculty, or staff member who is acting in performance of their duties.a) What was the directive that you allegedly did not comply with?
The directive was for the Asian student to go to the staff member's office. The request was uncalled for since it was unfair, and so the student did not agree to do as requested.
#2: Inappropriate use of electronic devices and social media, in a manner which may interfere with the academic learning environment, college activities, and the rights of other individuals.a) What electronic device are you alleged to have used?
They claimed that I violated with using the electronic device or cell phone.On the Syllabus, we are allowed to use electronic devices for class-related purpose and "Please speak English in our classroom (98%of the time)- At that time, this Mexican student communication language was "Spanish" for communicating with other students during the classroom, so I translated language from Spanish to English with a cell phone which created the violation of "Inappropriate use of the electronic device and social media, in a manner."b) Who is the individual(s) that you are alleged to have interfered with their learning environment?
First, this Mexican student should not have talked about non-related classroom work such as "Professor is sleeping with me, or she is sleeping with a Professor for getting a higher grade." in Spanish. Using a foreign language also leads to additional issues, especially if other students are aware of the language. This means they are loudly gossiping about the Professor while he is listening.
Second, the Mexican student chooses to use "Spanish" instead of using English as her language of communication with other students during the classroom means that she does not want me to understand what they have talked about, for harassing me with inappropriate language, that I translated from Spanish to English.
I have the right to choose to translate other languages from Spanish to English during lectures based on the diversity of cultures learning the ESL course. According to the New Jersey School Ethics Act Legal case under "Foreign Language," students are free to use translators if they have difficulties in a language other than their native language when communicating in the context of a classroom. Additionally, this means the students can use the devices for other purposes that have not been specified for the classroom scenario.
According to this school, it is the violation of " In a manner which may interfere with the academic learning environment, college activities, and the rights of other individuals. The violation was a distraction since other students were forced to concentrate on the words being translated and what they mean. The school also prohibits making calls and other noisy activities during lectures. However, the application relies on audio to work, and the output was a dictation was well for other students.#7: Bullying, harassment, and intimidation.a) What conduct did the school allege was bullying, harassment, and intimidation?
Translating the language from Spanish to English during lectures is regarded as harassment since the Professor feels that these Mexican students are using inappropriate language that makes it harder for him to determine what the students are saying. The Professor also feels bullied that the student alleges that he has affairs with his students, and he even goes on further to say, "I do not sleep around with students or flirt with men students."b) Who is the individual(s) you are alleged to have bullied, harassed and/or intimidated?
The Professor alleges that translating inappropriate words during class is comparable to bullying. The offensive words being stated loudly means the Professor also has to stop teaching, and the behavior shows a lack of respect for the lesson. The written and verbal communication used by the student towards the Professor is also regarded as inappropriate in content, tone, and frequency to the point that it can be regarded as harassment. In the current case, the student is learning the English ESL111 program during the classroom. Since he has noticed the other students using derogatory language, he has the right to translate any languages used by Mexican students, such as inappropriate slangs against Asian Students.
Based on New Jersey School Ethics Act Legal case under "Foreign Language," students are free to explore other languages without the need for the Professor to place through restrictions. It is imperative to allow students to preserve their native cultures and language. The curriculum materials have to be developed based on the experiences and background of the students.
