This will be a (eight page) position paper that could identify the actual legal issue(s) facing now or
faced in the past the company. After the legal issue(s) is/are identified the position
paper could present possible solutions to this/these issue(s).
CAUTION: Be advised not to over-concentrate on the historical aspects
of “their” airline and will be directed to follow a more critical path that relates to a legal
issue.
Advantages: To obtain an in depth understanding of the specific legal issues
relating to a specific company operating in the domestic and (if applicable)
international airline environment.
Research Topic Airline The airline of which I’ve choose to do my research on is ‘American Airlines’. American Airlines has recently encountered a legal issue concerning a Boeing 737-800 as it had been tampered with by an employee who hoped to gain overtime. “The arrest of a veteran American Airlines mechanic this week for allegedly sabotaging a plane at Miami International Airport an hour before takeoff in July sparked condemnation by the airline and its mechanics union Friday — and raised troubling safety concerns for travelers” (USA TODAY). I’ve chosen this Airline because it is known as the world’s largest airline and I believe that a legal issue of this degree must be thoroughly analyzed and worked out. According to the FAA, there are many rules and regulations that concern the tampering of aircrafts and so I plan to further explain and go into details about these regulations in my research paper. I also plan to address further legal issues that American Airlines have encountered and solved during the past as well as share my views on what can be done to improve the way they legally address certain dilemmas in the future.

The management of employees in American Airlines has failed in the delivery of services resulting in poor output in the general performance of the organization. Although the company merged with U.S. Airways to improve its products and services, the corporation has not reflected any significance in the industry (Leff, 2019). This iteration could mean that the problems affecting the organization are internal and the significant causes originate from the workers in the industry. "The merger of the two airlines was supported by its unions. U.S. Airways workers would generally get raises coming up to American Airline's levels of pay. Why American Airlines workers wanted the U.S. Airways management team to come in, though, was always a mystery (beyond mere resentment of legacy management) (Leff, 2019).” Ironically, a mechanic in the American Airlines tampered with a plane to get overtime payment irrespective of the high wages offered to the employees compared to the other aircraft companies in the country. The claim reveals that the major problem in the firm originates from the employees and the iteration is on the pilots handling the faulty planes. Do the people think about the populations of passengers that might lose their lives due to their greed to obtain more resources? The management in the organization has failed in the monitoring of workers, resulting in negligence and reduced output.
Pilots have to seek help in the control of the planes while up in the air. They not only have to protect the lives of the passengers but also their own since they are in the machine likely to crash any moment and cause destruction in the loss of lives and other natural resources. The pilots do not depend on the provisions offered by the organization entirely since failure in response can result in mass issues in the handling of the plane in case of a problem. “Legacy America West pilots were still paying a monthly fee to access their scheduling system even by the time U.S. Airways and American merged, for instance (Leff, 2019).” The pilots are forced to make extra payments to access the desired systems in scheduling to ensure maximum maintenance of the planes before and after every trip. Although the tactic worked in enhancing safety, the company should work on the conservation and management of their team to improve efficiency and reliability in their services. Resourcing ideas and help from outside their context and work setting is expensive, and the firm should look for alternatives to restore its accountability in operation.
On the other hand, the failures in the American airline's operation could have resulted in past issues such as the Boeing 737-800 tampered by an employee. The authorities handling the case revealed that the worker had disabled the navigation equipment (Vigdor, 2019). As far as the issue might look or sound insignificant, the plane could not take off at the required time. This issue affected the passenger's schedules as everyone designated for the trip had different reasons for traveling. For instance, they could be boarding for business trips, hospital appointments, and probably studies. The action endangered the lives of the passengers as well. What if the work did not affect the official start-up of the plane departing? This situation could lead to a more dangerous incidence in the event of the frail craft crashing. Instead of the mechanics maintaining their lines of work context in handling and repairing the planes whenever an issue occurs, they have deviated to becoming the major causes of the problems. In this case, the airline has to seek the right solutions, and the operation can only start through the identification of the primary cause of the problems and the best steps towards the process of achieving change.
However, the claim by the mechanic that he did not like the union contract idea by the American airline. According to the employee, the condition in the union contract did not have any possible leads to progress expectations (Vigdor, 2019). This claim means that the employees might have presented their opinions over the deal to the management in the organization and the primary cause of the iteration by tampering with the plane is the disagreement between the workers in what they thought should not be implemented and what the organization thought would work best for its success. The American airlines have the obligation of securing the protection of their passengers by avoiding and shunning such situations to ensure its cooperation with the employees since the organization cannot offer any services without the help of all the stakeholders. The company should understand that the participation of everyone working in the organization is significant regardless of their low positions. Although the mechanic was wrong in tampering with the plane, his reason might create some sense in the people dealing with the issue, with the company lacking evidence to counteract the mechanic and hold him accountable for his action (Vigdor, 2019). However, the idea does not mean that he implemented the right decision by altering the operation of such critical equipment in the plane because the action could result in tremendous damage.
The incident took place at Miami International Airport whereby the mechanic decided to sabotage the expected navigation of a plane, a while before takeoff. The authorities grounded the flight upon realization, turning down the anticipations of 150 passengers awaiting the flight (Vigdor, 2019). “The mechanic, Abdul-Majeed Marouf Ahmed Alani, 60, of Tracy, Calif., told investigators on Thursday that he had tampered with the air data module system on Flight 2834 from Miami to Nassau in the Bahamas on July 17,” revealing that he pleaded guilty of the placed charges (Vigdor, 2019). Although the acceptance could mean that the mechanic had genuine reasons in his implementations, the authorities cannot take the issue for granted and accept his ideas despite the underlying causes. He should have devised an accessible way, such as approaching the management in the effort to deal with the issue amicably. However, he chose the wrong and hard way, resulting in severe consequences like the involvement of the authorities and a worse impact on passengers upon the grounding of the flight. Also, the case was filed in federal court in consideration of the criminal attempt and later complaint after implementation and investigation.
