In Regents of the University of California v. Bakke, Allan Bakke filed a suit against the University Of California Medical School for being rejected twice, and he argued that his exclusion was solely based on race. The U.S. Supreme Court held that it was unconstitutional for the university to base its admission process on racial “quotas” (oyez.org, 2018). However, in certain circumstances, it was constitutional for an institution to utilize the concept of affirmative action to admit more minority students.
