Crimes against property (or Property crime) refers to the category of violations or felonies that are committed against the belongings of other individuals. While these crimes are usually lesser in severity as compared to crimes against persons, the prevalence of such crimes are some of the highest in the United States. In 2018 alone, about 7.2 million cases of property crimes has been reported all over the country CITATION Duf19 \l 1033 (Duffin, 2019). This suggests that law enforcement authorities should exert more effort in implementing the tools needed in order to thwart the high numbers of property crimes happening in the country. Nonetheless, this paper would examine the different property crimes based on the given scenario.
The Case
In this particular case, Bubba, Hurt, and Breeze were accused of stealing several items from Socks for Feet Outlet located at 222 Citation Way. Although the suspects seem to have acted in conspiracy with one another, each of them have also allegedly committed distinguishable actions that could be punished in different ways. Let us examine each in greater detail.
Bubba Hurt
Based on the testimonies of witnesses (especially of Mr. Foot), it seems that during the commission of the crime, Bubba Hurt (Suspect One) was able to successfully take three dozen pairs of Big Guy brand socks, valued at $432.00, outside of the company’s premises. The manner of the commission of the crime was even corroborated by the testimony of Andrea Sianturi, who works as a sales retailer at the same company where the crime is committed. Her written testimony states that Hurt took the said socks, hides them inside his pants, and escaped together with the two other suspects. Clearly, Hurt’s actions constitute the crime “theft by shoplifting” as provided in Section 16-8-14 of the Georgia Criminal Code, which is committed “when he alone or in concert with another person, with the intent of appropriating merchandise to his own use without paying for the same or to deprive the owner of possession thereof or of the value thereof, in whole or in part, does any of the following: x x x (1) Conceals or takes possession of the goods or merchandise of any store or retail establishment”.
