Introduction
Human trafficking is a criminal offense where minority individuals in a society are taken away without their consent. The victims are taken to other countries for labor services and at times used in sexual exploitation. It is a form of slavery where individuals are deprived of their rights either through fraud or force. Victims of this act mostly involve vulnerable minorities, a certain social group, race or tribe. The victims are isolated from their culture, families, social network and even their country. Human trafficking is a booming international business and people are becoming more aware of the impacts of this business but still most countries have not enacted laws to cub the business. Where these laws have been implemented they are not strong enough and neither the citizens nor the government have tried to see the laws are strengthened. This crime is an international disaster, and it requires working towards its elimination. Combating this crime requires a comprehensive national wide solution. (United Nations office on drugs and crimes 2007).
Human trafficking is so sophisticated that it can be considered from a number of distinct perspectives including: labour, crime control and lawless person justice, migration, sexual exploitation and human rights. This complexity is echoed in the broad variety of relevant treaties that simultaneously comprise the codified (treaty-based) lawful framework round trafficking. A small number of treaties, encompassing some that have been resolved recently, deal solely with the topic of trafficking. Many more addresses one slender facet, a particularly vulnerable group, or a particular manifestation of trafficking.
In the attempt to prevent, it is important to strengthen laws governing international labour recruitment. This is because this union is directly associated with labour trafficking especially in the United States. If these unions are strengthened by being more transparent, they will reduce illegal fees charged by foreign labour recruiters` officials. These fees lead to financial bondage, slavery or vulnerability of any other form to the workers being transferred and as a result, they are mistreated and exploited so as to pay these debts. There is a need for strict regulation for labour recruiters so as to protect documented workers on fraud in the terms and conditions of a job when entering a country. Once these laws are strengthened, workers will not be deceived any more since the laws will provide a concrete basis to refer to when it comes to the terms and conditions of any job. There is also a need to strengthen laws governing the visa program in a country to help prevent exploitation of this program by the international labor recruiters.
These recruiters operate in an environment of impunity. They promise workers good high paying jobs abroad and providing illegal visas, which eventually, force workers to stay in unhealthy exploitative conditions. Therefore, when strengthening these laws the government should be careful not to give these recruiters so much power on immigration regulations. Foreign labor contractors laws should be reformed in such a way that, workers can understand the work contract before migrating to that country for work and the contract details should not change whatsoever once the worker has moved in for his/her new job. In such law, no foreign recruiter is to provide force information regarding terms and conditions of work.
Another area that needs strengthening is recruiters` registration. Once the laws governing registration are strengthened, and foreign labor recruiters charge a certain fee whereby they are also supposed to submit a list of contractors regularly with their terms and conditions violation of contract details can be reduced. Once the foreign labor contractors fail to meet the requirement of the registration or violates the requirements of the employees then penalties should be enacted. (Ventrella, 2010)
Enforcement of laws on international immigration agencies are important in such a way that information on possible trafficking routes is shared internationally among all agencies will help in the conviction of the criminal. Such laws are at times violated by the law enforcement agents through bribery by the human traffickers making this effort futile.
These laws cannot be effective unless there are tools to identify criminals. This can be implemented by using international reporting and monitoring system in order to criminalize trafficking. In a study done by Gates foundation on human right found, shows that there was a 79% decrease in human trafficking in countries where strong regulations against this criminal behavior were implemented and followed in the latter. Laws should be strengthened in reducing impunity. For instance in California, the California agency of combating trafficking asserts that prosecutors require a strong legislative law to persecute criminals involved in this trade. In most cases, people involved in this illegal trade are prominent and powerful people in the government. Therefore, without enough powers and incentives to persecute them the victims will end up not being compensated. Even with strong laws in some countries it is still hard to stop this trade because the traffickers are prominent people who usually bribe their way out without facing the law. How will strengthening of the law work if the lawmakers themselves are involved in this business?
The government can decide to involve the citizens in curbing this illegal trade. Voters of a nation should disagree with this act than keeping quiet in their houses even in cases where they know the bandits and the victims (Gallagher, 2010). The society at large can help in strengthening these laws if they are actively involved in its amendment and implementation. It has been obs...
