Should Arizona’s judges be forced to retire at age 70?
I do not think Judges in Arizona should be forced to retire at age 70. The life expectancy in the US has significantly increased from the 1960s to date. According to data from the World Bank (n.d), the life expectancy in the US stood at 70 years in 1960. In 2016, the life expectancy had risen to 79 years (World Bank, n.d.). Therefore, it is not logical for judges to be forced to retire at the age of 70. If there is there a need for a mandatory retirement age, then it should be raised to correspond with the increase in life expectancy.
One of the arguments in favor of retirement age for judges is declining capability. However, this argument has fundamental limitations. According to Blackham (2016), age is a weak predictor of one’s capacity to work productively. Therefore, while some the capacity of some judges may decline with age, others fulfill their roles effectively into old age.
