Torts of Law Midterms Examination
A careful understanding of the application of the law in relation to a series of facts is essential for any legal practitioner. This includes the various parties in a case, as well as the different claims that each party could have against one another to be able to either enforce or defend a client's right. Accordingly, this essay will examine several legal claims that can be raised in the case of Brian Loneleyheart and various defendants, including Pearly Gates Nursing Home, Dr. Isaac Barr, Happy Pills Pharmaceuticals, The Patchwork Palace, and Brian Loneleyheart’s girlfriend (hereinafter called “Y”). The potential claims include breach of contract, negligence, false advertising, medical malpractice, product liability, invasion of privacy, and wrongful death. The essay will discuss the facts and legal principles that apply to each claim and the possible defenses that each defendant may raise.
Litigant Claims
Loneleyheart v. Pearly Gates Nursing Home
One of the possible claims related to the facts of the case is Brian Loneleyheart v. Pearly Gates Nursing Home, where the petitioner may raise several legal claims against the nursing home. One possible claim would be for breach of contract if the nursing home failed to provide the features advertised in the brochure. However, since the brochure is not included in the fact pattern, it is unclear if there was a breach of contract. Another possible claim would be negligence if the nursing home failed to exercise reasonable care in providing medical services or hiring and supervising its staff. For example, if the nursing home failed to supervise Dr. Barr, who misdiagnosed Mr. Loneleyheart properly, or if the nursing home failed to train Ms. Grace to protect residents' privacy adequately, Mr. Loneleyheart may have a negligence claim.
Additionally, the brochure was included in the fact pattern. In that case, Mr. Loneleyheart may have a claim for false advertising if the nursing home made false or misleading statements in the brochure. Pearly Gates Nursing Home may argue that it provided the services advertised in the brochure and that any harm suffered by Mr. Loneleyheart was not caused by its actions.
