Advocacy Through Legislation
Nurses often become motivated to change aspects within the larger health care system based on their real-world experience. As such, many nurses take on an advocacy role to influence a change in regulations, policies, and laws that govern the larger health care system.
For this assignment, identify a problem or concern in your state, community, or organization that has the capacity for advocacy through legislation. Research the issue and use the "Advocacy Through Legislation" template to complete this assignment.
You are required to cite to a minimum of three sources to complete this assignment. Sources must be published within the last 5 years and appropriate for the assignment criteria and relevant to nursing practice.

Problem

Fatigue, stress, and working for long hours around smells that would make any other person sick are part of the nursing practice. However, being assaulted or subjected to any form of violence is not part of the nursing practice. At any time, one out of every four nurses is assaulted, which makes nurses more vulnerable to workplace violence than prison guards and police officers. Despite the increased rate of violence against nurses, 50% of the cases are not reported (Potera, 2019). The majority of states have passed laws making violence against nurses a felony. However, in Kansas, the law only protects mental health personnel employed by the state. In 2015, the Kansas House Bill 2313 was introduced to protect all healthcare workers against violence but failed to progress from the health committee. With violence incidences against nurses increasing each day, Kansas should pass a law that protects nurses at the workplace.
Violence in any healthcare setting affects nurses, physicians, and all the personnel. However, nurses are more vulnerable to violence because they interact more with patients, have more workload, and work at night sometimes. If violence against nurses is not addressed, the job productivity of nurses will decrease and the cost incurred by hospitals and the state to treat and compensate assaulted nurses will continue increasing. A combination of these consequences compromises the safety of both the patients and nurses in Kansas.

Federal law directs health facilities, whether private or public, to admit and treat anyone who seeks emergency room treatment. As a result, nurses must treat anyone even if that person tends to assault healthcare workers. Conversely, it is only appropriate for Kansas to enact a law that protects nurses against violence during the course of their work. With regards to previous incidences of violence against nurses, the legislation enacted by Kansas should have the following aspects;
* Consider violence against nurses as a felony and enact a punishment of up to 6 years in prison or a fine that does not exceed $15, 000 or both.
* Should be broad in scope and define a felony offender as any person who causes bodily harm to an individual undertaking his/her duty at a healthcare facility and a healthcare worker providing case management to a patient in an office or at home.
* Direct all healthcare facilities to institute a quick reporting mechanism for violence incidences and establish a workplace violence prevention plan that educates workers regarding violence at the workplace.
Indeed, other methods can be used to address violence against nurses in Kansas. However, legislation is the only mechanism that can be enforced by OSHA, the Department of Health, and fine hospitals that failure to adhere. In case of a violence incidence, legislation is easily enforced in a court of law.

At the time of writing this report, more than 30 states have enacted laws that protect nurses against violence at the workplace. For instance, In the state of Illinois, violence against nurses is addressed by the Public Act 100-1051, which classifies any intentional harm to a nurse as a felony and directs all hospitals to establish violence prevention plans that follow OSHA’s guidelines. The efficiency of the Public Act 100-1051 is enhanced by the Illinois Whistleblower Act that allows people to report or release damaging information without any form of intimidation. In evaluating the effectiveness of state laws that protect nurses against violence, the study of Fitz-Gibbon and Walklate (2017) found that legislation correlates with lower rates of violence.
Evidence 2
Other than criminalizing violence against nurses, the bill proposed in this report requires hospitals to train all employees on how to deal with violent patients. In the state of Hawaii, SB2491 directs all hospitals to train nurses on how to deal with violent patients with regards to trauma-informed care. This approach allows healthcare workers to evaluate patients and take precaution before they are assaulted. Although it is costly, the implementation of this training program was supported by numerous bodies including the Healthcare Association of Hawaii.
