Introduction
International law constitutes the vital basis upon which the peace, justice and cooperation of nations are founded. Yet recent conflicts, like in the case of Ukraine and Gaza, have shown gaps about the capability of international legal structures to deal effectively with such wars. Shaw (2017) writes that the rise of more laws such as human right laws, trade laws, and environmental laws has seen major laws set forth in international laws dissolve. Furthermore, with globalization it seems that the world is slowly moving towards, “a specialized and relatively autonomous shares of social action and structures” (Shaw, 2017, p. 48). The conflicts in Ukraine and Gaza bring to light the disintegration of international law and the unsolved questions on the effectiveness of international law in intervening and ending disputes. Although international law defines principles that establish peace, justice, and humane treatment, the fact that these regions are experiencing war sadly poses the question of whether the law works or not. This essay evaluates the shortcomings of international law in current conflicts as seen through the case of Ukraine and Gaza. It examines issues such as implementation, accountability and conflict resolution.
Weaknesses in Enforcement Mechanisms
One of the main obstacles to the enforcing of international law is the lacking of widely recognized and enforced enforcement mechanisms. Numerous treaties and conventions that regulate state action and protect human rights around the world exist, however, the lack of effective enforcement reduces their efficiency and effectiveness.
