Step 2: Research Your Case

Find out the following information about your case:

  • Has a decision been made in your case? If yes, what was that decision?   • What is the issue being discussed? Summarize the main points.
  • What are the two sides of argument? Summarize those.
  • Why do you think this issue this issue is important? What impact could this have?

Conflicts are prevalent in the contemporary society. However, there are various institutions that serve as conflict resolution mechanisms. A good example is a legal system. Court cases comprise of the plaintiff, defendant and the jury. The plaintiff is the aggrieved party who files a complaint in court against the defendant. A good example of a court case in our modern society is one of Dollar General Corporation versus the Mississippi Band of Choctaw Indians where the Dollar Corporation is the petitioner, and the Mississippi Band of Choctaw India is the respondent.
Dollar general is a United States chain of a variety store and operates a store whereby the land is held in trust for the Mississippi Band of Choctaw Indians. Also, the store operates under a lease and a business agreement with the tribe. In 2003, around spring, John Doe a thirteen-year-old boy, alleged that he was sexually molested and harassed by the store manager Dale Townsend. The alleged incident occurred as Doe was undertaking his internship program at the store under an agreement reached by both the tribe and Townsend.[Michael Foley. Arbitrary and Capricious (Westport: Praeger Publishers, 2003), 36]
