Pre-Mediation Process Student’s Name Institutional Affiliation Pre-Mediation Process Every mediator is motivated to deliver the most effective and impartial session in each chance accorded. As such, understanding the process and probable outcomes before the session begins is crucial to mediators. The pre-mediation process is a significant one tor with the key elements of the case before opening a platform for him/her to develop a successful approach toward that specific case. Using examples and a range of activities, this paper assesses the steps in the pre-mediation process including the initial contact and intake, background investigation, and designing a plan. The analysis is vital in outlining some of the key prospects to consider in each of the three steps to advance an effective mediation. Initial Contact and Intake The first step in pre-mediation is when one or both disputing parties contact the mediator. In this initial stage, the mediator focuses on three areas including understanding the nature of the dispute, assessing the suitability of the dispute for mediation, and setting expectations (Moore, 2014). With this first phase complete, the mediator can understand if the case is suitable and how to set rules, fees, and any possible settlements. The pieces of information to gather at this stage include the identities and contact details of the parties, a brief on the dispute, expectations for each party, safety concerns, and the existence of any legal representation (Michigan Supreme Court Office of Dispute Resolution, 2005).
