They all attempt to explain why individuals behave in ways that violate social norms. Their efforts have led to multiple theories of crime and deviance. Most notably, some attribute crime and deviance to social, economic, and cultural factors rather than the individual. An example is critical criminology theories. Such theories propose that crime emanates from inequalities in class, race/ethnicity, and gender relations controlling the society and, as such, hinting at the role of power and privilege in determining crime. This is exactly what this essay explores – the role of power and privilege in the criminal justice system (CJS), specifically in the context of understanding crime and deviance. Power and Privilege Power and privilege can be defined in many ways. The conventional textbook definition aligns with Green et al.’s (2025) that power is the ability/capacity to make and influence decisions that impact others, while privilege entails the specific benefits, advantages, or even respect emanating from an individual’s association with a specific social group. In some cases, power is associated with social control based on the fact that individuals in power often exercise control over critical aspects of society. Even in a democratic society, governments use democratic control mechanisms, especially judiciary or the entire criminal justice system. However, it is vital to understand that power and social control, though related, are completely different constructs. Power often comes with privilege. In this case, privilege can also be viewed as possessing the right to exemption from duty or liability in addition to the social benefits and advantages. For example, in the context of CJS, a white individual caught breaking traffic rules may be let go with a warning, while an individual from a different race is prosecuted in court. This example demonstrates a power difference between two races and the privileges derived from such power difference.
