1 The issues involved in resolving legal disputes in international transactions
When any international body such as a multinational company attempts to find an amicable solution to any multinational business that is also referred to as an international transaction, there are usually a lot of challenges that may bombard the company. Study and research has shown that some of the torts incurred by the companies are probably of more importance to the Chief Executive officers of the companies and the company managers (Melviny, 2012). This is because the torts have a way of giving the managers some power to directly influence the business operations and relationships with other businesses.
One important issue in this case is usually the avenue for dealing with disagreements, which should always be a level ground for the both parties. The other issue is that the number of legal activities in companies` varies from one country to another; therefore one country may term as illegal what another country finds legal. In addition the companies entering into contract need to be sure that the contract they are signing is genuine and that the company is legal. It must ensure it is dealing with an enforceable contract. Other issues may include the choice of which law should actually be made use of in the circumstance of a multinational company, and finally, jurisdiction of the law.
1 Some practical considerations of taking legal action against a foreign business partner based in another country
The most palpable practical consideration that would aid in the decision as to whether there will be a legal petition against a business partner from a different nation is always the total cost of the legal action itself. Secondly, the company should consider the length at which the law and rules are applied in the subject of interest and most definitely, the company should also consider whether the venue for executing the legal action is a fair ground. Finally it is important to note, for example, that a law in the U.S is not a law in the U.K, and therefore, a law broken in the U.S does not necessarily mean a law broken in the U.K
