For a long time, businesses and individual entities have been able to use the court systems to address their issues regarding contracts and remedy their problems with other parties (Turban, 2007). However, over the years as well, there has been a change in the way the individuals and businesses carry out business as online transactions take shape. This means that more businesses are able to transact surpassing the geographical barriers (Dww.com, 2014). At the same time, there are more disputes that need to be resolved across the borders. The old justice systems that involve lengthy and expensive litigation processes are now gradually loosing favor too. In most of the cases, the parties seeking justice have had to endure laborious legal hurdles and in the end they have had to solve their cases out of court after realizing that they have to take the initiative. By this time the parties have all paid dearly through the bureaucratic process. Most of the parties now seek to try the out of courts mechanisms. This is due to the wave created as more parties seek to have less laborious means of seeking justice across the borders within the ecommerce industry. At the same time there are not well defined laws that are set out to handle the vastly developing market. This means that the law in place does not have all the provisions for most of the illegal aspects that take on the ecommerce platform. Due to the fact that the E commerce platform is huge spreading across borders without proper regulations, business parties involved in disputes are pushed to seek solutions outside the corridors of law and justice.
Most of the parties that have legal issues to resolve are turning to the Alternative Dispute Resolution other than the laws that have been set out on the land (Turban, 2007). The ADR is a method that is used in solving disputes other than the normal method of litigation through the court...
