Introduction
Each year, thousands of children are tried and sentenced to life imprisonment without parole in the United States for violent crimes. Trying minors as adults has sparked heated debates across the country and beyond CITATION Lou10 \l 1033 (Loughran, et al., 2010). Juveniles might commit serious offenses and for that, they must face the consequences but try them in criminal courts meant for adults is very least undermining their children rights CITATION Uni07 \l 1033 (United Nations, 2007). The legal system seems to be inclined towards being punitive rather than correctional for child offenders who are subjected to adult trial in criminal courts. The judicial system is designed to be correctional and serves justice for the victims, however, trying children in adult courts and sentencing them to adult correctional facilities taints the efficacy of an effective judicial system CITATION Red06 \l 1033 (Redding, 2006). Thus, thus article will focus on why children shouldn’t be tried as adults for their crimes.
Justifying the Topic
The reasons for the aforementioned topic is the statistics that show thousands of children are subjected to unfair trial each year and often incarcerated without parole. It is imperative to evaluate the rationales of the proponents and opposers of juvenile trial and incarceration in adult trial and correctional facilities CITATION Pat01 \l 1033 (Daley & Dahlie, 2001). The research would seek to offer a solution that is more inclined to rehabilitation that punishing for such minors. It would also seek to find a solution that reduces recidivism and does not infringe the rights of children who are suspected of committing violent crimes to help the society shift from punitive measures to a rehabilitative approach to dealing with minors accused of committing violent crimes.
