The supreme court of the United States, in its opined, that nothing could destroy the government more quickly than its failure to observe its laws, or worse, its disregard of the charter of its existence. By this statement, the Supreme Court meant that the government must abide by exclusionary rule as a controversial means of justice, failure to which the government will collapse. Based on a case between Torres Versus Lynch (2016), the paper will focus on the facts of the case, who was involved, crimes committed, and conviction and sentencing.
First, Jorge Luna Torres, a resident of the United States by law, a native, and a citizen of the Dominican Republic, pleaded guilty. He was convicted of the murder of attempted third-degree arson in violation of New York State Penal Law. On the second appeal, Torres argued that Congress intended section 1101 (a) (43) to worsen felonies to cover state law crimes that met all elements of a federal offense. The second circuit showed respect to what it viewed as a reasonable interpretation of a provision in question by BIA under the supreme court's decision in Chevron USA.Inc.V.Natural Res.Def.Council,Inc.,467 U.S. 837 (1984) (Tran, 2015).
