The United States operates under a constitutional framework that divides governmental power horizontally among three branches and legislative, executive and judicial; and vertically between federal and state levels. This system of federalism and separation of powers creates multiple sources of law and establishes hierarchies of authority. Understanding this structure is essential for comprehending how American law functions and how conflicts between different levels of government are resolved. The American legal system's organization reflects the founders' deliberate attempt to prevent tyranny through divided power while maintaining effective governance through constitutional supremacy. Understanding these structures and levels of power is crucial in also understanding how American law is organized, power is shared, and how various conflicts that might arise between them are effectively resolved.

The federal government has three distinct branches, each with specific constitutional roles and powers. The legislative branch, embodied in Congress, exercises enumerated powers including taxation, immigration, currency regulation, military affairs, and the power to make necessary laws that align with the execution process among other roles (Brooks, 2015). The executive branch, headed by the President, assumes executive power and implements federal laws. The judicial branch, comprising federal courts, exercises judicial authority and interprets federal law. Similarly, each of the fifty states maintains its three-branch structure. State governments feature a governor who heads the executive, state legislature, and state-level courts that possess judicial authority (OpenStax & Learning, 2019).

The separation of powers between the two levels of government reflects the constitutional principle of federalism, which forms two independent tiers of authority, each with the authority to act directly on behalf of the citizen, guided by the national Constitution. The federal government deals with issues that impact the entire nation, such as national security and economic prosperity, while state governments oversee regional issues like public safety and education. (OpenStax & Learning, 2019). This system emerged from the founders' experience under the “Articles of Confederation”. These articles had simply created a loose collection of independent states that had no centralized authority. A lack of a central authority meant that there were serious challenges in building an army, a centralized tax system and even regulating commerce arou
