Is it harmful/wrongful for the court to be activist in protecting the rights of the oppressed from governmental tyranny? Why? Why not? Support your answer.
In relation to the idea of the separation of powers within the government, I believe that it is harmful to the judiciary to pursue an “activist” approach since it goes outside its primary function, which could then lead to the collapse of the state. Although in most cases, judicial activism was perpetrated in the pursuit of a “noble cause”, I believe that technically, the Judiciary must be able to make decisions and impose sanctions based on the “objective facts”, rather the subjective ideas that rely on subjective thinking.
