For the past eighteen months, notable issues have been reported to have evidence the court could perceive as hearsay. Hearsay refers to an “out-of-court” testimony provided to justify the certainty of what it attests that is presented in evidence to demonstrate the reality of the situation. The issue with hearsay is that whenever the mentioned individual is absent, the provided evidence becomes challenging to create credibility, meaning hearsay evidence is usually not admissible in court. This paper reflects testimony from three cases regarding Tommy "Two Toes" D’Natalia, Luigi "the Pipe" Cardone, and Lawrence ‘Lucky’ Livorno. Through these three cases, the review will provide an analysis of examples of which testimony is and why it is hearsay and probable to be inadmissible. The review will also evaluate examples of which evidence is privileged communication and why and the function of the Best Evidence Rule (BER) about the witness testament. Getting insights into what hearsay includes and exceptions to its admissibility is crucial to legal specialists. One exception to the hearsay rule is the "excited utterance," which applies whenever a person makes a statement during a startling event, possibly offering accurate information (Legal Information Institute, n.d.-a). Another hearsay exception is the "statements against interest," which applies to activities or statements that negatively affect the party that made the testimony (Legal Information Institute, n.d.-a). From this understanding, the testimony of Luigi "the Pipe" Cardone, who attests that Big Sal Salvatore voiced to him that Frankie "the Lip" Bonnano claimed Freddie "Fingers" Malone was killed by his spouse Slippery Sally Genovese-Malone, can be perceived as hearsay. Cardone's testimony is grounded on hearsay, including Salvatore's claim concerning what Bonnano attested. Every layer of the hearsay is an out-of-court testimony provided to justify the truth of Sally Genovese-Malone's engagement in the killing. It is possibly not admissible because Big Sal Salvatore and Frankie “the Lip” Bonnano were absent for cross-examination. This example is hearsay because Luigi "the Pipe" Cardone’s statement entails relaying the information heard from others but not his direct knowledge. Cardone heard Salvatore attest that Bonnano told him the Malone's killing, making it out-of-court testimony provided for its truth and, therefore, not admissible. This information has passed numerous people, of whom none could be interrogated for credibility.
