The criminal justice system adopts custodial and non-custodial sentences. They include conditional sentences such as house arrest, fines, suspended sentences, probation, and imprisonment. According to Gikunda (2021), the judicial system adopted reprieve resulting in the birth of probation. Rather than serving time in jail, the offender is allowed back into the community. They are expected to observe some rules set by the court to avoid jail time. One of the pros of probation is the fact that, unlike jail time, it is cost-effective. Minimizing jail time through probation further address overcrowding issues, especially in prisons. It also entails allowing the criminal to undergo probation under close supervision, thus guaranteeing community protection. Light offenders are often granted probation, thus giving them a chance to reform, ultimately limiting the risk of becoming hardcore criminals.
