The case refers to one Mrs. Carpenter, the plaintiff. She died while under the care of the nurses in the hospital after undergoing a hip replacement surgery. After surgery, she was put under clinical management under the supervision of a post-surgical unit nurse. Before admission to the surgical unit, she was assessed by Kelly, the registered nurse and was found to be in a stable condition. As the post-surgical nurse made round, he noticed that the patient had become nauseated and was vomiting. He called the code and another registered nurse, David Casler gave her a respiratory therapy. What followed is the patient was found unresponsive and transferred to intensive care and later passed ways (Recupero, 2008).
