The key federal antitrust regulations include the Sherman Antitrust Act, the Federal Trade Commission Act, and the Clayton Act. These regulations prohibit unreasonable business practices that deny consumers the merits of a competitive market, leading to inflated prices for goods and services. Research indicates that antitrust law needs to be revised because acquisitions by tech companies are increasingly creating the potential for anticompetitive implications (Melamed, 2020). In this vein, it is necessary to prohibit big tech firms such as Amazon from making acquisitions by substantially revising the existing antitrust regulations. For example, the Sherman Antitrust Act prohibits conspiracies, contracts, and combinations that unreasonably undermine foreign or interstate trade. The Act also outlaws measures executed to monopolize interstate commerce (United States Department of Justice, 2022). These provisions are ineffective as it fails to regulate big tech firms. The rise of big tech provokes unease in the existing antitrust legislation because its influence is increasingly expanding without limit through scope and scale economies as well as network effects (Melamed, 2020). This is because big tech business is anchored on new and significantly invisible technology.
