A rock radio station owned by RKO Gen Inc. and with a widespread teenage audience had a competition which rewarded and recognize first contestants to locate a roaming disc jockey with twenty five dollars and an interview with the DJ. Two minors driving in different cars and without knowledge of each other followed the disc jockey's red car to its next location after someone else had beat them in the first loation. In their pursuit, one of them carelessly forced a car off the highway, killing its driver (Weirum). The driver`s surviving wife and children filed a suit against the radio station. The jury hearing the case rendered a verdict against the radio station in the favour of the victim`s family for compensation worth $300,000.
Issue
The issue in law here was whether the station owed any duty of care to Weirum. The driver was entitled to protection basing it on the aspect of the two minors should have known that it was their duty to look out to other motorists Donoghue v.
