Difference between primary and secondary sources for the tax system
The bedrock of tax law is constituted by primary sources—those foundational documents delineating the regulations and rules that govern the tax system. The Internal Revenue Code (IRC) constitutes the fundamental legal framework for taxation in the United States, while Treasury Regulations function to explicate and clarify the IRC's provisions (Zarin, n.d.). Case law, as well, is a crucial primary source of tax law, as judicial decisions establish precedents that can subsequently be used to inform interpretations of the IRC and Treasury Regulations.
Although not carrying the force of law, secondary sources can be instrumental in elucidating tax law.
