Ad Hominem: This is the portrayal of biasness toward someone due to the consequences of his or her actions. In this case, the public, prosecutor and the judge were biased McPherson due to his consequences. Irrespective of the fact that his acts could not be constituted as murder, the prosecutor and judge considered them as murder.
Fallacy of Exclusion: This constitutes generalization of facts with regard to the conduct assuming that the behavior was too unique. In this case, Macpherson’s conduct was generalized to mean that it was despicable to all drivers. In addition, that his case was supposed to be a deterrent to all drivers, this was virtually wrong. Moreover, his acts were generalized to mean that since he had caused deaths, this should virtually translate to murder.
