Federalism refers to the relationship between the federal government and state governments, especially in the criminal justice system, where there is often conflict due to overlapping authority (Vile, 2022). An example of a modern problem that highlights these tensions is the process of election administration, which, although it is not a criminal process itself, dictates the manner in which criminal justice institutions are formed. In the Bost v. Illinois State Board of Elections case, the federal candidates tried to challenge the Illinois statutory rule that permitted mail-in ballots to be received within fourteen days after Election Day (Oyez, 2025).
