Federalism and Criminal Justice Remember that the federal government is only permitted to act in certain circumstances that are outlined very clearly in the U.S. Constitution. If it does not have the authority to act, the states are responsible for acting instead. This Discussion’s Learning Resources explore the impact of federalism on the criminal justice system in local, state, and tribal jurisdictions. The role and impact of federal supremacy in relation to immigration enforcement, for example, is a primary tenet of U.S. immigration law. Understanding the concept of criminal federalism affords the ability to explore the impact of federal criminal laws over what are considered local matters.
