While the property was sold “as is” to Jennings/McCallum, the owners (Karren Spann, personal representative of the estate of deceased Robert Spann) did not abandon or relinquish the rights to the hidden money discovered. Besides, the money ($500,000) was hidden in ammunition cans to indicate that the real owner had preserved it for a purpose. Law categorizes found property in four ways; mislaid, lost, abandoned, or treasure trove. Property is considered “mislaid” if the owner intentionally placed it in a particular place and later forgot about it. “Lost” property is that which the owner unintentionally parts with either through neglect or carelessness. Property is considered “abandoned” if it was voluntarily forsaken. Property is a “treasure trove” if hidden for long to indicate that its owner is unknown or dead (Terry v. Lock, 37 S.W.3d 202 (Ark. 2001).
