When using private and non-profit sectors in disaster operations, an emergency manager must make several considerations. In contemporary America, no elaborate federal laws provide immunity to private and non-profit sectors participating in emergencies. Additionally, there lacks adequate judicial precedence to sufficiently shed light on the best practices to follow when volunteers are involved in emergency response (Mead, 2016). Consequently, the emergency manager finds themselves in a complicated situation due to the ambiguity mentioned above ambiguity in the law. Consequently, the emergency manager must consider several legal issues when using the services of private and non-profit sectors in disaster operations.
The first consideration the emergency manager should make is to be well-versed with the particular state laws concerning emergency operations. In the United States, there are no uniform federal laws that guide volunteer liability protection in emergencies. However, most states do provide some statutes to guide these operations. Therefore, the emergency manager should be well versed with any statutes and the implications of the same in emergency response. Evidence has revealed that these statutes are varied from state to state and are often difficult to understand (Horwitz & Mead, 2009). Therefore, to take the best action, the emergency manager should seek advice from a legal professional. A legal professional can break down the provisions of state laws regarding emergencies, thereby helping the emergency manager to make an informed decision.
Secondly, an emergency manager should consider the licenses or permits required for different emergency volunteers.
