In other words, if your roommate comes home with a bag of cash and you ask him, "Hey, did you steal that!", and he does not answer, then this is an admission of guilt. The prosecution would call you to testify to discuss this encounter with your roommate.

In my opinion, the adoptive hearsay exception is pure speculation that may lead to the sentencing of an innocent person. This rule assumes that when a defendant adopts an accusation by silence, they are guilty of the crime. The idea behind this exception is that when a suspect is falsely accused, they would immediately deny it. While this may be true, I would argue that suspects, whether guilty or not, automatically deny their charges until the prosecutor establishes further evidence that implicates them.
