Property refers to the right that a person has on something, maybe a piece of land, apartment, etcetera. The following case questions have discussed personal property, real property, and breach of contract and remedies.
Breach of contract and remedies cases
Case question 2, Laura is expected to recover the amount as she had agreed with Anthony because of the liquidation damage clause. That states the amount specified should not be more than probable damage that could be sustained, and in this case, the provision has been satisfied (Twomey, Jennings and Greene p348).
Case question 4, the contractor must pay the stated amount since he failed to act in the manner called for when there was a need to perform the contract, which leads to the breach of contract.
Case question 6, the buyer is entitled to be paid the specified amount he gave as a down payment to the seller because the anticipatory repudiation allows the party to make a prior decline to the contract before it starts (p345).
Case question 10, the homeowner must receive the compensation of an amount equal to the damage done to the interior part of the house because of the roofer failing to turn up when duty called without prior notice (p 348).
Case question 11, the defendant, who is Madison, was correct since before Ken joined the diving course, he signed a form that releases Madison and YMCA from liability of damage that might occur. In this case, Madison is not liable for the death of Ken.
Personal property and Bailment cases
Case question 1, the creditor can raise execution against a Winnebago mobile home owned by both husband and wife, under the same obligation because of the co-tenancy right that allows two or more people to own the property (p 368).
