The accident had taken place at night when Steele, who had been drinking with two friends in his car, hit a man, later identified as Dudley Fishburne, on Claiborne Avenue. A breathalyzer test later revealed that Steele had a blood alcohol concentration BAC of 0.080, which is the legal limit for DUI in Louisiana. Although the state has formally charged Steele with DUI and vehicular manslaughter, let us take a closer look at the facts of this case. The DUI charge primarily relies on the fact that the Breathalyzer at the scene had a reading of 0.080 of BAC with Steele. However, Steele's attorney intends to present scientific data suggesting that due to a margin of error in Breathalyzer, it will be proven that at that time, Steele's BAC was below the legal limit of intoxication. If this is so, it must be said that the general acceptability of the DUI charge can be brought into serious question. The law in Louisiana proclaims that any driver with a BAC of 0.08 is considered legally intoxicated, but if the margin of error can work in Steele's favor on the DUI case. The conditions surrounding the accident do not make the case any more accessible. Fishburne, who had a BAC of 1.00 and marijuana in his system, was trying to cross the street at the site of an exit ramp from an interstate highway.
