His condition is steadily worsening,and he has not responded to appropriate antibiotic therapy. You consult with the ICU attending and jointly decide that ongoing intubation is futile. You consult withRichard and decide to remove the patient from the ventilator to allow him to die in the morning. That night thepatient's parents arrive from overseas. Theyare devout Muslims and threaten a lawsuit if the ventilator is withdrawn. Prior to the arrival of the ICU attending in the morning, you are in part responsible for dealing with grieving family members. In the case of the forty-year-old man, the legal, ethical decision maker is the partner. Since he has a durable power of the attorney assigned rights, he has the rights of making any ethical decision on behalf of the patients. His decision to have the ventilator removed is in line with the physicians’ analysis of the deteriorating condition of the sick man. Also, the law provides autonomy for children under the legal age of maturity. Parents do not hold the rights of making ethical decisions for their children who are considered mature entirely on their own. The first alternative decision maker becomes the spouse or a partner.
